Terms & Conditions

These Terms & Conditions govern the nomination and role of a "Trusted Person" on AfterLifeDiary service. By accepting this role, you agree to comply with the responsibilities and obligations outlined below. This agreement is binding and enforceable under applicable laws.

A Trusted Person is an individual nominated by the account holder to manage, access, and safeguard their digital content and memories after their death, as per their explicit wishes and AfterLifeDiary platform policies. This role carries significant emotional and legal responsibility.

The Trusted Person role becomes active only after the following conditions are met:

• Verified Notification: Verified notification of the account holder's death through legal documentation
• Documentation: Submission of required legal or supporting documents as requested by AfterLifeDiary
• Approval: Formal approval by AfterLifeDiary's verification team

Until all conditions are satisfied, the Trusted Person role remains inactive and inaccessible.

Once activated, the Trusted Person may:

• Access specific parts of the account as permitted by the account holder's instructions
• Manage, preserve, share, or memorialize content based on written instructions
• Maintain and protect digital memories including photos, videos, messages, stories, and documents
• Facilitate the viewing and sharing of content with authorized family members or beneficiaries

The Trusted Person agrees to:

• Act in good faith, with integrity, and with utmost care
• Respect the wishes, intent, and instructions of the account holder
• Maintain confidentiality and privacy of all stored content
• Avoid misuse, alteration, or unauthorized sharing of any content
• Use the account solely for the purposes authorized by the account holder
• Promptly report any security breaches or unauthorized access to AfterLifeDiary
• Keep login credentials secure and never share them with unauthorized parties

The Trusted Person:

• Cannot transfer ownership of the account to another person
• Cannot use the account for personal gain, profit, or commercial purposes
• Cannot alter, delete, or modify content except as explicitly instructed
• Must comply with all applicable laws and AfterLifeDiary platform policies
• Cannot monetize or sell any of the stored content or memories

Right to Accept or Decline: The nominated individual has the unconditional right to accept or decline the Trusted Person role.

Right to Withdraw: The Trusted Person may withdraw from this role at any time by notifying AfterLifeDiary in writing, effective immediately or on a specified date.

Revocation by Platform: AfterLifeDiary reserves the right to revoke access in cases of:

• Misuse of the account or content
• Violation of these Terms & Conditions
• Breach of applicable laws
• Security concerns or suspicious activity

AfterLifeDiary is not liable for:

• Actions taken or omitted by the Trusted Person in their role
• Disputes between family members, beneficiaries, or related parties
• Loss or misuse of data due to negligence by the Trusted Person
• Unauthorized access resulting from compromised credentials

All data and content will be handled in strict accordance with:

• Applicable data protection and privacy laws
• AfterLifeDiary's Privacy Policy
• Industry best practices for secure data handling

The Trusted Person must ensure that the privacy, dignity, and confidentiality of the account holder are always maintained. All content should be treated with the same care and respect as the account holder would have desired.

Any disputes arising from this role or these Terms shall be:

• First attempted to be resolved through good-faith negotiation
• Subject to applicable jurisdiction and governing laws
• Resolved through mediation or arbitration as per AfterLifeDiary's dispute resolution policy

AfterLifeDiary reserves the right to modify these Terms & Conditions at any time. Significant changes will be communicated to active Trusted Persons. Continued use of the Trusted Person role implies acceptance of updated terms.

• Read these Terms & Conditions in full
• Understood all responsibilities and obligations
• Agreed to be bound by these terms
• Accepted the sacred duty of protecting a digital legacy
